Selling a behavioral health practice in New Jersey
New Jersey has licensed behavior analysts since the Applied Behavior Analyst Licensing Act was signed in January 2020, and NJ FamilyCare has covered ABA for members under 21 with autism since April 1, 2020. Substance use treatment licenses are not transferable and become void when ownership changes, and running a facility after a transfer without prior approval is treated as operating without a license.

ABA therapy: licensure and NJ FamilyCare
Governor Murphy signed the Applied Behavior Analyst Licensing Act on January 13, 2020. It requires state licensure in addition to Behavior Analyst Certification Board credentials: licensed behavior analysts hold a master's or doctoral degree and BCBA certification, and licensed assistant behavior analysts hold a bachelor's degree and BCaBA certification.
NJ FamilyCare began covering ABA on April 1, 2020 for Medicaid members under 21 with an autism spectrum disorder diagnosis. Because the Medicaid benefit and the licensing law both date from 2020, buyers look at how your payer mix and clinician licensing have developed since then, and how much revenue comes from NJ FamilyCare plans versus commercial insurance.
Substance use treatment: ownership changes need approval first
Under New Jersey's licensing standards for substance use disorder treatment facilities, a license is not assignable or transferable and becomes void if the program's ownership changes. Operating a facility after a transfer of ownership without prior approval is treated as operating an unlicensed facility, with penalties.
That puts state approval squarely before closing. Buyers will want a clear plan for the licensing filing, the expected review time, and how the facility keeps operating lawfully through the change.
Outpatient mental health
Outpatient therapy and psychiatry practices are valued on clinicians and payer contracts. Buyers will look at how many clinicians are credentialed with each commercial plan and NJ FamilyCare plan, how much of the volume you personally deliver, and how stable clinician tenure has been. Practices with physicians usually sell through an MSO structure, which counsel should review early.
